We have growing optimism that the legislature may pass a cancer presumption. Multiple studies continue to document a near epidemic of cancer in fire service. Both Dade and Palm Beach County have experienced very high levels of cancer in active and retired firefighters, further suggesting an occupational cause to this horrible disease. Although these claims are complicated due to the current state of workers’ compensation law, we will continue to take occupational cancer claims for firefighters everywhere in Florida and expend resources to push for a long overdue cancer presumption in the legislature. As of November 2015, the Firefighter Cancer Presumption Bill (SB 456-Latvala) was reported favorably out of the Senate Community Affairs Committee.

Cancer Bill Analysis

On Friday, May 3, 2019, Governor DeSantis signed the new Firefighter Cancer Benefits Law. The law provides firefighters with any of 21 forms of cancer the full cost of treatment along with a $25,000 payout. It also grants disability pay and death benefits for beneficiaries. The bill also treats cancer and cancer deaths like on-the-job injuries and death. For more details on the new Legislation please review the Bill Analysis by Managing Partner Geoffrey Bichler.
