1ST DISTRICT COURT OF APPEALS SELECTS GROUNDBREAKING CASE OF MILES V. EDGEWATER FOR ORAL ARGUMENT IN MIAMI ON JANUARY 21, 2015 at 9:00 A.M.
In a surprise move the First District Court of Appeals selected the case of Miles v. Edgewater to be argued in conjunction with the Winter Meetings of the Workers’ Compensation Section of the Florida Bar on January 21, 2015 at 9:00 a.m., at the University of Miami. This remarkable case has been handled by the attorneys of Bichler/Kelley since officer Miles was exposed to chemicals at a meth lab and her claim for medical care was denied. The dispute centers on several important constitutional issues that the Court will hear during oral argument including whether Officer Miles’ First Amendment freedoms were violated, and whether the Workers’ Compensation Act remains a viable alternative to common law rights and remedies where First Responders are injured in the line of duty. The Attorney General’s office has intervened and will argue in favor of the statute and, by implication, the employer. The stakes could hardly be higher.
All First Responders should be aware of this important court date and attend the hearing if possible. This will be a unique opportunity to see the wheels of justice in action at an extremely high level.
